☀ In a blow to Ordinance Raj, a constitution Bench led by Chief Justice of India T.S. Thakur of the Supreme Court has widened the boundaries of judicial review to the extent that it can now examine whether the President or the State Governor was spurred by an “oblique motive” to bypass the legislature and promulgate an ordinance.
What now? The satisfaction of the President under Article 123 and of the Governor under Article 213 is not immune from judicial review.
Background: The question reference before the seven-judge Constitution Bench dealt with the constitutionality of seven successive re-promulgations of the Bihar Non-Government Sanskrit Schools (Taking Over of Management and Control) Ordinance of 1989.
The State government had approached the Supreme Court after the Patna High Court declared that repeated re-promulgation of the ordinances was unconstitutional after relying on the D.C. Wadhwa judgment on promulgation of ordinances in 1986.
☀ The Department of Personnel and Training has extended the tenure till March 31, of the C.R. Kamalanathan Committee which was set up for overseeing division of employees between Andhra Pradesh and Telangana.
- Note that: The Kamalanathan Committee was set up at the time of bifurcation of Andhra Pradesh in 2014 for dividing 57,700 government employees belonging to 153 wings of various departments.
☀ Terming religion a very private relationship between man and his God, a seven-judge Bench of the Supreme Court on Monday, in a majority 4-3 judgment, held that an appeal for votes during elections on the basis of religion, caste, race, community or language, even that of the electorate, will amount to a ‘corrupt practice’ and call for disqualification of the candidate.
- Election is a secular exercise and therefore a process should be followed.
- The SC was interpreting the word “his” in the Sec 123 (3) of Representation of People Act.
- The provision mandates that “it would amount to a ‘corrupt practice’ if a candidate or his agent or any other person, with his consent, appeals for votes on religious or such grounds”.
☀ The Railway has suspended four staff members for negligence in duties in connection with the derailment of Sialdah-Ajmer Express at Rura railway station near Kanpur last week.
- In the Rura incident, 62 passengers were injured when 15 bogies of the Sialdah-Ajmer express derailed on 28th December.
☀ Google is commemorating the 186th birth anniversary of social reformer Savitribai Phule on the occasion of her birth anniversary.
Savitribai had many firsts to her credit — she was the first woman teacher of the first women’s school in India and a pioneer in modern Marathi poetry.
The Government of Maharashtra has instituted an award in her name to honour women social reformers.

☀ In Iraq, a suicide vehicle bomb driven by Islamic State terrorists killed at least 39 people in an attack on a busy square in Baghdad. The IS claimed responsibility for the blast.

☀ Taking a cue from the SBI, other banks including the largest private sector lender ICICI Bank and state-owned Oriental Bank of Commerce and Andhra Bank have also announced cut in marginal cost of funds based lending rate. Note that: Prime Minister Narendra Modi had urged the banks to focus on the needs of the poor and lower middle class and middle class in his new year eve address.
☀ Absentee landlords and food processing companies hiring land for farming will be covered under the GST. While expanding the definition of agriculture to include dairy, poultry and stock breeding, the Goods and Services Tax (GST) Council declined entry of individuals leasing out farmland on rent or share cropping as agriculturist.
